OK - I thought it might be helpful if I tried to address many of the concerns posted here at once.

The changes to the updated PSA involved removal of legalese and redundant language, and better organization (i.e. any language about termination or deactivation throughout the old PSA was moved into section 6 in the new PSA). This is the basis for the differing looks of the new/old PSA.

A list of some of the some changes:

Network Quality:

NQ has always been an important aspect of the CJ network, and in order to address emerging promotional methods and to be clear about our position regarding certain promotional methods, we revised section 2 of the PSA, and included a reference to the industry standard affiliate marketing Code of Conduct.

The specific prohibitions in the section 2 of the updated PSA now include:

* the placement of links in third party blogs/newsletters/etc. (not your own website or blog) to address SPAM,
* the operation of a website without a privacy policy, so that it is transparent to general users what type of information is being collected and tracked when they use your site (this is also in anticipation of federal legislation regulating the use of cookies),
* the use of pop-ups and pop-unders, to address adware/spyware,
* and self-designation of your account as "special" if you use alternative promotional methods, to add transparency and address Advertiser concerns over what type of methods are being used to promote their products.

Billing/Payment/Tax info

Section 2 (a) was added requiring Publishers to provide accurate account information and keep that data current, so we that CJ has accurate contact information and tax information.

Charge-backs

The charge-back language in section 3(b) of the updated PSA was modified, but it did not change how CJ operates regarding charge-backs. Both the old and updated PSA’s allow for charge-backs at anytime for violations of the PSA, and specifically identify the 5 instances that advertisers may implement charge-backs. This is not new. Our updated ASA similarly addresses this issue and limits an Advertiser's ability to chargeback. Affiliates should give us the benefit of doubt that CJ will be strict on this issue, since CJ doesn’t get paid either when a chargeback occurs.

Use of Publisher trademarks

Both the old PSA (section 4.1) and the updated PSA (section 4) provided that the parties granted each other the right to use content and trademarks provided to each other through the network.

Termination/deactivation

Section 6 of the updated PSA states that we “may” terminate an inactive account after 30 days. The 90 days in the old PSA was removed as it conflicted with both the old and updated PSA language that allows for termination by either party upon 30 days notice. We do not plan on terminating Publishers for inactivity after 30 days.

Marketing

Section 9(h) gives CJ permission to market Publishers, both in the network and in CJ materials. CJ has always promoted Publisher’s in an effort to match you with advertising partners, and with the creation of the CJ Performer program, CJ wanted to make sure that it had permission to market you and your programs.
