I just found this interesting blog post about a workaround for accepting NY affiliates.

Reinstate NY Affiliates Step One

In a nutshell, it seems like if an affiliate only places a link on there website and does not ACTIVELY pursue sales, then we would be exempt from claiming nexus sales?

Am I reading this right and is it too good to be true?!?!?

The thinking is that we won't actively market to New Yorkers, yes. I've heard nothing to indicate that it has been changed since that post.

As far as I know that's still the case. At least that's the approach we've been taking. You might consider trying to contact Mellie, the author of the post, and who is really a great person. I don't have an email, but you can try through her blog. (Or maybe Twitter - Twitter)

I noticed the terms on a merchant's program just today that there are some limitations imposed on NY affiliates, like flyers and email marketing in NY but they are being allowed, yes. The terms only mentioned NY affiliates regarding the limitations. I would imagine that if it is part of your SAS agreement that the checkbox would signal the affiliate's agreement to the terms. The merchant is putting their trust in affiliates to honor the agreement.
