3 States dead to rights.... Many, MANY more (I have a figure but can't share it) sending out marketing questionnaires to large internet retailers.....
Isn't it time we all got behind the Streamlined Sales Tax? At the risk of dealing in hyberbole... your State could be next. Affiliate Marketing in the large scale hangs in the balance, folks. It's time to act.

I remember Mellie saying it would be a good idea to start compiling links to nexus defnitions by state. This is VERY important, as it is likely to differ from state to state. The tax may not be enforced where you are yet, but you, as an individual, need to be aware of the wording, so that when it does happen (and it will), you'll already have a starting point.
With that said, I took 30 minutes and found the Illinois definition: http://www.ilga.gov/commission/jcar/...00G08010R.html (c) is the relevant clause. |

Thank you Carolyn. Under the new "broad brush" being used in the latest inquisitions, I'd say there's some risk there. Item 2 under c specifically states soliciting, and that term has moved into the danger zone.

But since those were not enforced (with internet merchants) in the past 15 years they (the states) feel they have to pass "refresher" laws. Our best protection is probably to push for some kind of "Streamlined Sales Tax" for internet sales. But that seems more like a job for campagnies the size of Google or Microsoft (i.e with direct access to senators and the likes). |
