I thought I would start a thread for merchants not terminating California affiliates.

If you are a merchant that will be keeping California affiliates in your program please list your program here.

That will help California affiliates find programs that they can keep using.

I was confused until I re-read your post. I knew there was a thread already (and I'd just submitted a suggestion to moderators that the NewEgg post be merged into that thread), but now that earlier thread is gone. Apparently you hit the wrong button somewhere.

Folks, PLEASE POST OR RE-POST the names of any merchants who have indicated that they will CONTINUE to allow participation in ther "affiliate programs" by California web publishers. Don't assume that just because a merchant hasn't yet terminated California publishers, they will not do so -- only name merchants who have clearly stated that they've considered the issues raised by the "Advertising-Nexus" law and that they will continue to work with California publishers (perhaps because they collect sales tax here, or because they don't expect to reach the sales thresholds in the law, or because they've decided to defy the law because it's unconstitutional).

Shoe Shopping Spree is *not* terminating affiliate accounts. Open for business and shipping to California without sales tax.

And also keep in mind that any store/merchant that has a physical location in CA already charges sales tax and so the Nexus does not affect them and so there is no reason for them to cancel CA affiliates.

Looks like Drugstore.com is now collecting sales tax for Illinois purchases, and didn't terminate affiliates. I believe their collection is the direct result of the nexus tax law passing in Illinois. This is important for a few reasons:

- They previously terminated affiliates in NY, NC and RI because they're located in WA and don't have nexus in those 3 states.
- They were recently purchased by Walgreens. Walgreens, based in IL but with nexus practically everywhere, was a major proponent behind the affiliate nexus law in Illinois. They pressured Governor Quinn to sign the law. We have been waiting to see if they would collect or not, and it looks like they started collecting just shortly before the Illinois law went into effect July 1st.
- As I understand it, Drugstore.com is likely a separate entity, a subsidiary of Walgreens, and so probably technically wouldn't have to collect where they themselves don't have nexus. But I would call it very bad form if they didn't, considering the battle Walgreens waged against us.
- They are not collecting at the point of purchase, sales tax is added on when the credit card is charged, so your receipt won't match your credit card statement. That doesn't sound very kosher to me, but I'm guessing that's the only way they could comply with the law in time to hit the July 1 deadline. Adding it to their shopping cart, particularly with their huge variety of goods with different tax rates, must be a huge development effort.
- I bought something from them a few weeks ago, I live in CA, and they didn't collect sales tax from me at that time. Since they aren't collecting at point-of-purchase, I'd have to buy something from them again, and I'm not inclined to give them any more of my business.

As of now, Fanatics and Surf Fanatics will not be removing CA affiliates.

We'll be collecting sales tax and keeping affiliates on board.

Recent changes in California legislation has caused quite a stir for affiliate programs throughout the country. We would like to assure you that we will continue to offer our Sheet Music Plus Affiliate Program for California. As our business already resides within the state of California, we collect sales tax on orders placed within the state. The new legislation does not affect our Affiliate Program.
