You know the background now they collect tax on sales to NY.

Here's an interesting twist, if you're seller within their site, they refuse to collect tax on orders within your state (not just NY).

They say we need to build it into our pricing, or in other words we're supposed to eat the tax.

I guess when you're the 800 lb Gorilla you dictate the terms, but is it legal?

I think that Amazon enjoys the tax break and built their business on it. Now that its becoming an issue they are trying to sustain their model. It is inherently unfair to the states but its not Amazon's place to collect the taxes. They are going to continue to ride this train as long as possible. And they are not an affiliates friend but are using their affiliates to go after the states.

Affiliate could careless if taxes are collected and will push the biggest consumer advantage. They have no control over it and its not so black an white for merchants either. What might garner attention is if merchants will not sell online to the nexus states.

It is in NY, on all direct sales (that they ship) of their own products they do collect it.

When a merchant ships it they absolutely refuse in writing, "build the tax into your selling price" that my friend is inherently unfair.

There still is no national mechanism to collect the taxes and it will take a constitutional amendment to create one. I think it starts with states making it easy to collect then approaching the merchant. Little chance of that happening as they are cutting budgets and don't have the expertise. Plus short of suing out of state merchants the majority will not collect until forced to.
