Got them too Herb. Thanks for the heads up on this, terminations were in CJ mail only, not recieved in my regular email.

Anyone have a good website for crayons? Wonder if Roseart has an affiliate program?

Interesting that Homeelement would jump on the bandwagon so late in the game. Did you respond and ask why? Curious because I haven't heard that there were any new developments.

Regarding the appeal that was argued last fall, rumors were that there would be a decision from the New York Supreme Court 1st Appellate Division by late January. Now, all that I can find are hopeful statements that a decision will be released before the court's summer recess in July.

while I was really wondering (thought by now there would be tax liability established before this) I just let it drop. Think it is more important now to just bring in the replacements, as I have since May 2008.

Happens for a few reasons. Some include:
1. Approaching threshold
2. New (and sometimes misinformed) manager, CEO, accountant..
3. Merchant desire to trim their program and use sales tax as excuse
4.Nexus Questionaires from a state regarding in-state activity causes kneejerk reaction
5. Joining the "take a stand" bandwagon
6. Following steps or actions of others
7. Listening to the spin that is rampant and basing business decision on something other than actual facts

Unfortunately we have recently decided that at this point and time we are unable to work with the affiliates that are located in the Nexus Law states (NY, NC, RI). We value you very much as a partner, but we are unable to move forward with publishers that are promoting from those states. We have set the relationship to expire, and you will be removed from the program in seven days.
If any of those specific states overturn the current law, we would be happy to have you as a partner again. If you change locations to a different state, please let us know and we would be excited to accept you back into the program. It was a difficult decision for us to make, and we please hope you know that we are sorry to lose the potential of our partnership."

Because of recent tax law changes we have decided to end our partnership with some affiliates.

BetterWorldBooks dot com (CJ) dropped me as a result of being a New York affiliate. I can't find the email, per say, but when I contacted them directly to reapply, I was given the following message:

Hi Ryan,

Thanks for your interest in becoming an affiliate of Better World Books, it is greatly appreciated. I regret to inform you, however, that due to the "Amazon" law in New York, we cannot accept any affiliates from the state. I apologize for the inconvenience and thank you, once again, for your support.

Update: it is now the 27th and sas is still showing me active in the My Toy Box program. It was supposed to be terminated on the 22nd. I guess I will have to contact them....

whether they are active with you or not, you can drop them in the "activity summary" link in SAS, 2nd one down on the left.

Received this today from Shindigz:

Since 2001, Shindigz has partnered with several New York affiliate Publishers through Commission Junction. Unfortunately, the recent passing of the Affiliate tax law in several states forces Shindigz to terminate our affiliate program for all states in which this tax law has passed, including New York-based CJ Publishers. The law specifically imposes the collection of taxes from consumers on sales by online retailers, including but not limited to those referred by New York-based affiliates like you, even if those retailers have no physical presence in the state. We regret that its enactment forces this action.

As a result of the law, our Commission Junction contracts with all New York affiliates of the Shindigz Affiliate Program will be terminated and those NY residents will no longer receive commission for sales referred to Shindigz.com as of May 31, 2011. All qualifying commission fees earned prior to May 31, 2011 will be processed and paid in full in accordance with our regular payment schedule.

You are receiving this email because our Commission Junction records indicate that you are a resident of New York. If you are not currently a permanent resident of New York and feel you've received this message by mistake, or if you are relocating to another state in the near future, please let us know by sending an email to nzehr@shindigz.com, attention Natalie Zehr.

Please note, this development will only impact our ability to continue the Shindigz Affiliate Program in New York and will not affect the ability of New York residents to purchase online at Party Supplies, Party Supplies Decorations.

You can add Stumps Party supplies to the list, too.

We got dropped in CJ by..

bass pro shops (last year)

This year by in CJ ..

RockyMountainATVMC.com (never accepted)
Dennis Kirk (accepted then dropped)
MotoSport (this one hurt)

Not accepted in CJ by...

Revzilla.com (never accepted)

All because of the NY affiliate nexus law!!! We are an outdoor powersports niche and this has been affecting allot. Is adsense going to start not running ads on NY sites for merchants that do not charge NY residents tax? What's the difference?

Adsense is providiing the ads that could or could not lead to sales on the merchants sites, yet they still run on our site for the above merchants....

Important Update from SHOEBACCA:

Unfortunately the Nexus Tax Law has been evoked in relation to affiliates and therefore, forces out of state retailers to collect online taxes. Thus, SHOEBACCA will be removing affiliates in the states that have incorporated the Nexus Tax Law. We understand that this is disappointing, however we appreciate your support and are available to answer any questions you may have.
