Thread: NikeShop.com Over Charging NYC peeps Tax

It seems that NikeShop.com thinks the sales and use tax in NYC is 10.2..% instead of the actual 8.375% it currently is.

I was over charged 2 dollars in tax, and they basically said I probably will not get a refund because it's such a small amount.

My guess is their accounting team catches the overage and doesn't send it to NYS and instead gives it to their execs as bonuses. Just a theory.

Over charging tax may be a crime in some states.

Whats funny is when I first called they told me they charge tax on shipping, which is fine but still they are overcharging me by 2 dollars.

But when I look at past orders where I paid shipping tax was not charged to the shipping and the correct amount of tax was charged.

So if they don't charge tax on Shipping I am actually owed 4 dollars.

They refunded the taxes after some *****ing.

You should check NY's sales tax statutes and see if sales tax is charged on S&H. In many states, consumers don't pay tax on S&H.

@bibby I am not sure if that is the case in NY a lot of merchants charge and a lot done charge tax on S&H to NY and googling hasn't been my friend on that.

A little late but, NYS does require collecting sales tax on Shipping fees.
