I am continuing to work on the issue.

Anyone from NC who would like a conference call set up to facilitate working on it as a group merely has to contact me, that offer still stands.

I will also probably set up a more general call for all affiliates in the near future, might have more participants.

Well thank gosh you're there Mellie. I was beginning to talk to myself which is never a good sign in a forum. lol

Thank you for your help. I am on board with a conference call at anytime. I want to keep fired up about this issue! (as I change my thousands of links on my site...) Every time I change a link, it somehow feels good, like a weight lifting off my back! I think I can make just as much money promoting other merchants who are willing to work with me. Its more work but hey, no one said life was fair.

I talk to myself quite often lol. One of the reasons I started NYAffiliateVoice was so I could talk and not feel crazy when there weren't any answers.

Taking action to replace those dead or inactive links is actually very empowering. Make sure you diversify all your replacements, instead of just one merchant use two or three. Takes a tremendous amount of work and you will probably want to remove some non performers a couple of months from now but your business will be stronger.
One suggestion as you replace merchants is to start a spreadsheeet with information on each merchant. Include the current relationship status with regards to sales tax- safe or vulnerable (ie merchant collects NC sales tax online, non tax product, you are paid per click, per lead ...are safe under threshold with taxable products is vulnerable)

Looks like the Budget Reform and Accountability Commission has set up a form for the general public to post comments and suggestions on how the state can cope with the recession, streamline its programs, and keep NC competitive. It might be a good idea, to send our opinions on the Nexus law and how it doesn't help with any of these things.

I have been busy doing other things but just found out this morning that my amazon account had been closed. In researching this further I found this thread.

I myself am also effected by this as I have several sites running amazon cart type scripts (aom). We were just starting to get the traffic built up after quite a bit of money spent investing to get these sites off the ground. Due to the economy, medical and personal issues we have already been hit hard trying to keep our business afloat, even loosing our home in the process.

I dont know what the current state of this is but count me in. I would love to join the fight and do what ever I can. Where does this currently stand?

This is an excellent suggestion not just for the tax situation, but for the GAN situation as well. I really feel for any NC affiliate that is facing both problems. Mellie, your advise is good. I wish you would post it on the GAN forum as well.

Thanks.

skimmed this thread, but 21 pages is a lot to sift through... does anyone know if the 2-step process that is so nicely outlined on the NY Affiliate tax nexus forum is also the same process needed in NC and RI?

The Affiliates of New York Present the Tax Solution
As a result of the efforts of the Affiliates of New York and all of their supporters (both known and unknown) we are proud to offer the following information.

There are two simple steps merchants and affiliates need to take to comply with the NY tax law.

There are two documents to download that include steps merchants need to take and more importantly, sample agreements.

Here is a brief summary:

Step one is to add terms to affiliate agreement. Out of state merchants need to add a contractual condition to their affiliate program terms that prohibits New York affiliates from solicitation activities.

We now have the paragraphs that need to be added to terms.

Step two is Proof of compliance. This is accomplished by requiring affiliates to submit on a yearly basis, a signed certification that they, the affiliate, have in the previous year complied with the terms of the agreement. This agreement is due on or before May 31 of every year and must be retained by the merchant.

We now have a sample agreement.

Here is the link to our version of letter outlining steps to take and all the sample agreements. Letter to merchants outlining Merchant's Two Steps to Comply with NY Internet Tax Law http://docs.google.com/Doc?id=dhb7zz4d_10fjfnjqdq

We are also providing the lawyers' version of letter to merchants. This detailed versions offers some background information and additional details that some CFO's, CEO's and others might prefer. Detailed Information on How to Comply with Tax Law http://docs.google.com/Doc?id=df8mcjj8_2fv5dqtc3

Hi all,

Please check out the new thread on the Governor's Budget Reform and Accountability Commission. They are looking for ways to save money and increase revenue (like repealling the nexus legislation!).
