So, I went to GAN and looked at the Nespresso TOS and I see some things I've never seen before in a merchant's rules.

This is the section:

Please be advised that Nespresso campaigns CANNOT be promoted with or be associated in any way, with any advertiser that is tied to or in any way related to any content related to: sexual or adult themes, environmental, religious, children, retail partners. For example, if a co-reg path has any adult, sexual content, environmental, religious, Nespresso CANNOT be promoted anywhere in the path.

Examples:

Sexual/Adult content include, but is not limited to: Victoria's Secret, Lingerie, Hooters, Las Vegas, condom ads, adult sites, adult paths, any paths with adult content, any newsletter with adult theme, any emails with adult content or referencing adult content. Environmental: treehugger.com, NGO’s (i.e. Greenpeace, EDC, etc…)

Religious: Any site or page with a religious affiliation or theme

Retail: Williams-Sonoma, Bloomingdales, Sur La Table, Crate & Barrel, Macy’s
Second part first: "Retail": I do not understand what this is supposed to mean. Is it saying that you cannot promote other merchant's products on the same website page? On the same website? Can't compare products from different merchants with Nespresso? Really confusing.

The other section - much more difficult to accept: Nespresso seems to be applying a political litmus test into its approval process. I find it very distasteful in general, and on the specific issue here, environmental preservation, absolutely repulsive. So anyone who might support environmentalism by promoting green products and/or organizations is denied access to the program? What if I have a green living site but only wish to promote Nespresso on a different site? What if I have a political blog (on which I write about environmental issues, among other issues) that is totally separate from my consumer product sites?

As someone who spends much time engaged in political activities, including many of a pro environment nature, why would I want to promote a program that opposes any protect the environment actions?

Those are odd, I'm sure tree huggers drink coffee. Also this - Nespresso Ecolaboration - Home that's all about eco stuff.

Thank you for your question, as you bring up valid questions that some other prospective affiliates may also have about the terms of the Nespresso affiliate program. By restricting promotion of its ads in conjunction with certain types of web sites, our client is simply trying to avoid potential misconceptions by some users that it supports the positions reflected on these sites. However, after digesting your feedback, you've helped us realize that we may want to revisit the wording of these terms to better communicate this objective.

With regard to the restriction of association with certain retailers, our client values its relationships with its select group of distinguished retail partners and therefore, does not wish to compete with their efforts to market Nespresso products.

As the terms of the Nespresso affiliate may seem a bit more restrictive [or different] than those of other merchants, by making prospective affiliates clearly aware of these restrictions up front, we feel we’re providing the detailed information affiliates need before making the decision to submit an application to join the program. We recognize that great affiliate programs are built on partnership and appreciate your feedback on this.
