    Rewards Programs Sued for Patent Infringement

    Looks like someone may have rights on the loyalty-cash-back idea. It'll be interesting to see how this pans out.
    Seems like a broad patent, and these are some big guns to try to milk money out of, so I wonder how far it'll go.

    I don't think I could ever feel good about someone suing just to pressure others into paying money that might not be deserved. Whether we like those being sued or not, I don't think our courts should be cluttered with this kind of thing. They know most will settle and pay money instead of paying legal fees and going to court.
    I am not confident that their claim would hold water but they know people will pay up.

    I've been following this pretty closely. I'm not a patent attorney, but I did research the patents online in depth (you can actually pull them up through the Patent Office and read all of the details). While they make no mention of anything Internet related and propose using tracking by people's birthdates and social security numbers, I can see why a few of the companies would throw some money at them just to make them shut up.

    It's very suspicious that they continue to file in the most patent-holder friendly district in the US, although they actually do not do any business there at all. I was surprised at the range of sites listed in the suit--from a couple with only 5K-10K members to huge credit card companies.

    I can only imagine who they might sue next. Probably my local radio station because they have a "listener rewards" program that includes a couple of shopping "points" links in addition to everything else they do. Maybe even my daughter's PTO. It looks like they will try to sue just about anyone to scare them into paying some licensing money.

    Not that I have any love for many of those being sued, but I don't understand how they can claim rights to the whole "general idea" of cashback. It would be like the very first merchant to offer an affiliate program suing every subsequent merchant offering an affiliate program.

    One of the companies being sued should follow through and win. If they keep settling, this person will continue to bring lawsuits and make themselves and their lawyer richer.

    It would end up making Upromise even stronger because they are paying for the license already. I have to wonder if a couple of the others might be as well and that is why they haven't been named in suits?
