Was just remembering that I have some income coming in from 2nd tier stuff. While I've never actively promoted 2nd tier, some folks had apparently found my websites back in the day, and joined up.

If merchants that I don't actively promote now are dumping me from their programs, I'm losing the second tier income while not presenting a threat to them in the form of moving them towards the presumption of Nexus, since none of those sales can be attributed to me.

This needs to be thought through as well. Regardless of the legislation, I don't deserve to lose that income (with the obvious exception being that a merchant can terminate an affiliate at any time for any reason).

Secondly, shouldn't we be allowed to recruit for programs like this? I don't believe recruiting affiliates in any way moves us towards generating the presumption of nexus.
