    Looks like on top of all it's other problems, Ebay's knee deep in legal troubles over phoney goods.

    Some things to think about...

    If a Supermarket sells tainted food and people get sick, can you sue the guy the Supermarket leases the building from?

    If I own a 40 acre lot and lease tables for a flea market every Tuesday and you buy a fake Rolex, can you sue me?

    I think that may be a little different - look at craigslist. Having the entire site moderated by the users, and not staff, they are off the hook for legal issues. However, if you moderate your site and allow something illegal, you can be held accountable. As I understand it.

    Answers:

    Yes and Yes (you can sue anybody).

    More important question: Can the person suing win?

    Answers:

    Yes and Yes, if he can prove that the lessor had knowledge that 1) the supermarket was either intentionally selling tainted meat or acted with gross negligence and/or reckless disregard for the safety of its customers in selling meat that could well be tainted; 2) the vendor was selling stolen goods and continued to rent him space.

    No you can't in most states. You can TRY to sue anybody. That's what pre-trials are for, the judge can tell you to go pound sand.
