    What are your points of view on these terms and conditions imposed by a merchant called Interflora?

    Not bidding on a keyword brand name is a perfectly acceptable request, but the rest seems a little over zealous.

    Affiliates' use of Interflora's Trade Marks must be limited to the creative and text supplied by Interflora through TradeDoubler. Any other use is not permitted unless prior permission has been granted by Interflora. The Interflora Trade Marks or any confusingly similar names, such as (but not limited to) "Inteflora," must not be used:


    as 'keywords', 'Metatags', 'alt tags', or any other such device;
    in any part of a site's HTML;
    as part of the Uniform Resources Locator (URL), a path name, a directory name.or an e-mail address;
    in banner advertising or any other type of electronic advertising, that would, in the opinion of the Association, mislead the consumer to believe the site belongs to the Association;
    For the purpose of diverting users to sites not owned by Interflora or to give priority to sites not owned by Interflora over interflora.co.uk.

    The contents of Interflora's literature and all websites owned by Interflora, including but not limited to interflora.co.uk, are protected by copyright.

    Affiliates must not directly or indirectly bid on the Word Mark 'Interflora' or derivatives or confusingly similar words (see Interflora FAQ) in order to procure a higher listing within Internet search engines.

    Any other use is not permitted unless prior permission has been graned by Interflora. Please forward any queries to trademark@interflora.co.uk.

    Keyword bidding is prohibited on these keywords.

    You may need to write back to them and explain the keywords:
    flower
    florist
    wedding flower
    balloon
    flower delivery
    christmas flowers
    send flower
    valentines flowers
    mothers day flowers

    Are not trademarked and anyone can bid on them, if they feel the need to demand such a request you will have grounds to take legal action against them. You may want to let them know you will be forwarding there list to AmerianGreetings to inform them they are infringing on Interflora’s keywords.. ha ha ha bet that will give them a shock they would not expect!

    Some Companies think we are stupid, what they are hoping is that we are not aware we can actually bring charges against them.

    I would thank them for the list of keywords and use them to promote their competition.

    So many merchants just don't "get it" do they?

    Unfortunately, they can make any requirement or limitation they want to in T&C's, no matter how *ssinine, as long as it is not illegal. Abiding by their rules is a "condition" (the C in T&C) of participating in their program. It's sort of like Amazon's old requirement that all their affiliates put their stupid banners above the fold on the home page of any site that has Amazon links. It was stupid and controlling, and destroyed creative flexibility, but it was one of their conditions to play their game. Thank goodness they finally dropped that one!

    The options are 3-fold:
    1) Contact interflora and work out a modified set of T&C's for your relationship
    2) Accept their T&C's as given with the knowledge that no-one will ever find the site
    3) Walk away.

    My guess is that most people will walk away, or break the T&C's and risk forfeiting payment.

    Silly merchants!

    Better not put up any of their banners then! They may say "Interflora" on them! And, if this merchant is fairly typical, THEY would have put their name into the Alt tag of the banners they make available. Better not use any links without checking!

    In fact, best to play it safe and not promote this loser at all!

    Needless to say, I think their demands are totally ridiculous. Trust's solution is along the lines of my reaction--although I wouldn't thank them, the competing pages would just appear in the next index.

    There are plenty of other flower programs.

    Based on those demands, I would not mess around with these guys.

    Floral wireservice company attorneys can be really ruthless. Run away!

    Promote the competition and make sure they do not carry any interflora products.
