    As you may or not know, IHC is requiring everyone in Salt Lake and Davis counties to submit to mandatory abritration in the event of medical practice before receiving care at IHC facilities. It is IHC's intention to make this practice statewide.

    The problems with this practice are several. In several Utah counties and towns, IHC owns the only medical facilities. The agreement takes away your constitutional right to seek a jury trial if you don't like the outcome of the abritration process. The abritration process is designed to maximize the benefit for IHC and minimize the benefit for you the patient. Since abritration hearings are closed to the public, there is no way of knowing which doctors are routinely being accused of medical malpractice.

    As far as IHC's claims that this will help control costs, the facts prove otherwise. In 2000 and 2001, there were a total of seven malpractice lawsuits in Utah and only 2 were ruled in favor of the paitent. For 2004, IHC is demanding a double-digit increase in premium rates even with mandatory abritration.

    The good news is that you can do something about this. PAMMA is a citizens group set up to fight mandatory abritration. It only takes a couple of minutes to sign two petitions and fight this trend. Their web site is:

    Even if you are not on IHC, this decision can still affect you. It is based on a law passed by the Utah legislature and therefore if IHC is successful, other healthcare providers will likely follow. Keep in mind, I'm not advocating lawsuits, but rather protecting everyone's right to sue in the event of medical malpractice. No business should ever have the right to take away one's constitutional rights.
