    Circuit City - What about commission
    Hi All,

    As we all know Circuit City is going out of business. What happens to unpaid commission?

    Concerned about some rebates that we submitted 2 months ago. Currently in the last stage of processing..

    If you are just pulling your links now, there is no one to blame but yourself. Seriously, this is a business, evaluate your partners. Any commissions you lost here is your own fault, these signs weren't just clear, they they were written on the inside of your eye lids.

    These commissions are from past (October, November). My site is new and i didn't had enough commission to get paid in Novermber or December. So I am wondering if Circuit pays GAN every month or do they wait until i have enough commission to get paid?

    ACPD, I would bet $1000

    Circuit city hasn't been paying GAN for months, at least the final months. There are 5 million suppliers ahead of you, GAN is ahead of you. Everyone and their mother with some kind of claim against CC is ahead of you.

    5 years from now you might, if you are really really really lucky get a check from some court you never heard of and the amount will be so low you will wonder who paid for the postage and why couldn't they at least send you that amount.

    Those are my guesses based on every single other company I have seen go bankrupt, but maybe this time it will be different!!!

    payroll will have the first wack at what is left, (it always comes first)
    then all the government agencies, lawyers and secured creditors,
    unsecured creditors such as affiliates are so far down the list that the chances of seeing anything are minimal.

    Can Google be sued for this by affiliates who lost commissions as a result of GAN's promotion of CC despite not paid by CC

    Anybody can sue anybody, but I don't think you would win.

    And you wouldn't be doing any business with google in the future...

    They can also be removed from the Orange Links. I'm just now going thru them and see all kinds of deals/links for Circuit City.

    Most likely your agreement with Google would prohibit this, (and if you tried they would drain you dry with legal fees). The level of proof needed to show that Google acted contrary to that agreement is more than you’ll most likely be able to obtain.

    We are working with Circuit City and legal teams to understand the status of commissions.

    1. Pre-Chapter 11 filing: We do not have any update on commissions filed through the bankruptcy courts, which are as follows: July, September, October and November 1-9.

    2. Post-Chapter 11 filing: We are entitled to dollar-for-dollar payment on all post-Chapter 11 filing, which is as follows: November 10-30, December and January to date. Today's liquidation announcement does not change this.
    In general I believe this means that Post-Chapter 11 commissions earned are more likely to be received first (opposed to Pre-Chapter 11). And therefore would assume that Pre-Chapter 11 commissions earners would get pennies on the dollar as compared to what was actually earned. This would be dependent on how much CC gets from liquidation versus how much other debt gets paid first... agreed?

    Got a payment notification today for my November (Black Friday) sales for CC. Never thought I'd see a dime, but was very happy to be wrong this time.
