Many thanks to other AM - Trademark poacher
I want to say thanks to Chuck Hamrick, Bob Drumm - AC Lens, Brian Hawkins -Pingo.

I have been playing cat-and-mouse games with an affiliate that I suspected of doing TM bidding.

They told me about that affiliate after I asked them but it took me 2-3 weeks to catch him / her red handed with proof.

    What the affilaite did
    -Geo-Targeting
    -Day Parting
-Copied my exact ads on Google and I was not able to differentiate it from my ads when I used https://adwords.google.com/select/Ad...ingPreviewTool

Email that affilaite but no reponse.
Let's just say I did a lot of reversal, reported it to Brian and Carolyn, did the PPC bidding complaint + left a negative feedback. He/she is no longer promoting us

    Thanks All!!!

I'm new to this forum so I'm not sure if this has been discussed but can you get their Google account closed?

You are very welcome Eric as it works both ways. Just want to mention that there are forums where we discuss concerns like this out of the public eye. Through a collaborative effort we are helping each other and policing OUR industry. Ask a moderator for help if you are an affiliate manager and we will point you to the right place.

For those who PM me. I replied.
    Thanks!

For those who are asking. I used a few things:
    1) Communicated with Other AM.
    2) Google tools - https://adwords.google.com/select/Ad...ingPreviewTool
Type in your domain. Select on the right, "LOCATION", there, you will see if that is your AD that is being displayed.
    3) Brand Verity.
They have a 2 weeks trial. I could not justify paying $300/month for that service. If you manage multiple clients, you might be able to justify that.

Yes, I would hope that Google would close their AdWords account for blatant actions like this.

The owner of the trademark needs to file a complaint with Google to start an investigation. If the complaint is proven valid then Google will prohibit the infringer from using the trademark terms in question but it doesn't appear that they'll close the account.

I suppose it's possible that if they receive enough complaints about a particular advertiser that they may close or suspend their account, but there's no mention of that in their policy.

    Here's Google's Policy.

Eric, glad to have bin able to help.

I like Linkshare's IP report that helps you sometimes track back the clicks, to see what an affiliate was bidding on as proof with a search engine screen shot of the ads.

    @Brian-Pingo,

With this affilaite, he would redirect his links off his own domain. SAS does have a last click from but that is not much from a help as it get wrapped in his own domain / ip addresss.
