    The main focus of this letter is on out of state taxation with a mention of Article I, Section 9 of the U.S. Constitution prohibiting the taxation of articles of commerce from one state to another.

    I enjoyed reading the open letter; enough so that I added a comment. Upon posting my comment, it then takes you to a solicitation to "get paid for reading email?" I was disappointed to see that, but oh well...

    The problem is that use tax regulations have been around for quite some time (1935 in California), and have probably been tested against the constitution at some time. http://www.boe.ca.gov/sutax/faqusetax.htm has more information on the use tax. Technically, you're supposed to pay use tax on anything bought from out of state that you didn't pay state sales tax on.
