    The lawsuits filed all allege unlawful conduct involving trademark infringement and dilution and unfair competition under both federal and state law as well as deceptive trade practices in violation of New York state law. The Complaints also allege that the defendants are selling and importing non-FDA approved sildenafil citrate in violation of U.S. law, including the Federal Food, Drug and Cosmetic Act.

    Pfizer Inc is filing lawsuits against the following 5 entities/individuals:

    ORIONTECH, a foreign entity, and DOES 1-10 (
    YOU SAVE RX, an Entity Doing Business in New York and DOES 1-10 (
    CNR INTERNATIONAL, INC., a Foreign Corporation, and DOES 1-10 (
    CHARLES WILLIAM NARON, an individual d/b/a MY RX FOR LESS (
    Uniform Domain Name Dispute Resolution Policy (UDRP)
    More than two dozen UDRP actions were filed to seize domain names using Pfizer's Viagra trademark in an unauthorized manner. Each alleges that the respondents are using the Viagra mark in bad faith to sell product that has not been approved by the U.S. FDA.

    Being in the pharmacy and gambling space right now doesn't strike me as a good place to be. Between all the lawsuits by the companies, seizures by the US government and more recently a bunch of private suits, think the golden age of affiliates (at least in the US) promoting gambling and pharmacy may be coming to a close.

    As affiliates, we're in the sales chain for the products we promote. Not a real problem on most goods and services, but we could certainly become targets if we are promoting illegal substances, or products that are violating trademarks, or products that result in injury or death. In civil suits, plaintiff attorneys like to name everyone they can, and then sort through the "guilty parties" as they proceed through depositions and case investigations. Very, very expensive to be on the receiving end of this type of suit. We need to be very careful about the products and merchants we promote.

    Yup, I have been telling people about the pharmacy end of it for a while. Saw the writing on the wall. If you are promoting a company that is in this industry, better make sure they have that license (or whatever it is to meet FDA approval) if you are marketing in the U.S. They are going after affiliates too. Don't think you're safe if you or the company are in a country like Canada. The young over there may think we are the evil empire (according to Oreilly anyway) but the two governments usually work close together on matters such as this.
