Trial offers - FTC and Visa compliance

So as an advertiser, how do you deal with the fact that when you go completely clean and compliant with full terms and conditions disclosure, your conversion rates tank, while there seem to be plenty of new fish with high converting non-compliant offers?

I deal with this question all the time from clients. I tell them:
1. Just because others do it without being caught does not mean you will not be caught.
