    Affiliate Marketing website - UK Laws etc? help!
    Hi there,

    After a week or so of deciding I want to get into affiliate marketing I've decided that I want to make a Niche site that lists a lot of products, for example football boots. The site would have all the major shops products and the user can click on one and it links them to the actual seller where they can buy it.

    However, I'm struggling already! I'm concered about laws and things I have to obey to as I live in the UK, so was hoping someone can help me.

    Are there any laws I need to follow?
    What is all this about 'EU cookie law'? what do I have to do?
    Are there any UK laws I need to stick to?
    Do I need to register as a sole trader?
    Do I need a business bank account or anything? I read somewhere I did!?
    Do I need a Terms and Conditions page? How do I write one?

    Argh! Help!

    You must decalre all income from whatever source to HMRC against which you can set off all relevant expenditure, you must also submit annual returns on line, details can be found on the HMRC website.

    You are already established as a sole trader in the eyes of HMRC but can also register a trading name under the 1985 act.

    I recommend you keep all your transactions relating to any trading completely separate from your personal business so a seperate bank account is a must.

    I understand that I would need to sort out HMRC for the income I make and taxes etc however what do I need to follow in terms of the actual website?

    Do I need a T&C?
    Do I need a disclaimer, a lawyer, a privacy policy? what are these things?
    Are there any other laws people could sue me for?

    The last thing I want is some court case I don't even know what the hell is!

    You are no more vulnerable on line than if you ran a bricks and mortar business be diligent don't try to cheat anyone, misrepresent the facts or be guilty of plagiarism.

    Do you need T's & C's or disclaimers? it depends on your model, ask advice from your merchant or look at what the competition is doing.

    A privacy policy is a good thing to have there are loads of examples on the web and unless you become big enough for the premier league you are unlikely to need a lawyer although you may need an accountant for your tax returns.

    If you keep a clean ship you are unlikely to run aground.
