    California Privacy Policy
Noticing more and more merchant websites having a separate "California Privacy Policy".

    Any affiliates doing this?

Every web site should have a Privacy Policy. Currently, in the U.S. there is no law requiring a Privacy Policy (with exceptions for banking, medical, etc.) so most sites just follow the California law in creating their policies. Since California is about 20% of the country's GNP, this makes a lot of sense.

Some sites, however, try to distinguish between their regular Privacy Policy and their California Policy. I personally tell my clients not to try this. There is little to gain, and a lot of downside if they don't follow their own policies correctly.

I've heard there are new laws in CA requiring affiliates to identify themselves as part of their whois on their sites, email lists, etc - anyone converted to this yet?

Have any links to this? Does it pertain to CA residents/affiliates only?

I know of no new law in California concerning the Privacy Policy. What is new is that California has funded a new enforcement agency:

SACRAMENTO Attorney General Kamala D. Harris today announced the creation of the Privacy Enforcement and Protection Unit in the Department of Justice which will focus on protecting consumer and individual privacy through civil prosecution of state and federal privacy laws.

I can tell you that we have separate tactics on how we approach things such as privacy policy based on state.

For instance our Search Marketing Standard magazine is an annual subscription that is automatically renewed on your anniversary, except for CA. Also when a person denotes they are from CA we don't pre-opt them into email lists.
