PA Affiliate Nexus Tax Does Not Include CPC (cost-per-click), Only CPA

The Performance Marketing Association had a small victory in PA the other day. PA is now stating that only CPA (cost-per-action) links posted on PA affiliate websites will constitute a nexus in the state and that CPC (cost-per-click) links will not. Granted that most affiliate links are CPA, this may seem insignificant to most PA affiliates, but it is a victory nonetheless.
I'm curious as to how this will play out with eBay since their affiliate links are CPC. I contacted them yesterday but I'm still waiting for a response.

Yeah, its unfortunate. I've been dropped by what seems like a large number of merchants. I sent an email a few days ago to to the communications coordinator for the house appropriations committee chairman who I spoke with in the past. I sent him a few emails from merchants dropping me because of the new interpretation of the existing law (note, not a new law that needs to be vetted and voted on). No response to my email. I might ping him again letting him know I appreciate his concern.
