New York Court of appeals rules the state can collect sales tax from out-of-state retailers - NYPOST.com
New York’s highest court ruled yesterday the state can collect sales tax from out-of-state retailers, rejecting claims by Amazon.com and Overstock.com that the tax law violates the US Constitution’s Commerce Clause.

Wow. After waiting all these years, this decision was not at all expected, is clearly self-serving (promoting the financial interests of the state of New York) and is WRONG, and there will certainly be a writ of certiorari to the US Supreme Ct submitted.
Note how inaccurately the NYP has described the ruling, saying that it means that NY can collect sales taxes from out-of-state retailers, completely omitting the basis of the ruling that out-of-state retailers can be compelled to charge sales taxes on purchases made by NY residents.
