    Writing a Terms of Service document
    I am in the process of developing a deal/coupon site with a forum. Any suggestions on where to begin? Should I hire a lawyer who is familiar with deal/coupon/forum sites, or build from scratch by looking at other similar sites' ToS for ideas?

    First survey sites through organic search, then figure out how you would be able to offer something better. Wouldn't need a lawyer unless there were legal issues or tax nexus issues. Perhaps AffiliateHound can chime in as he has law experience.

    I would be more concerned with the terms of service for each merchant program you plan to join..

    User-generated content is a tricky area, and would have to closely monitored.

    Yes, I will have to moderate the forum closely, but would having a ToS for both the deal site and forum protect me? I mean, if a user signs up and agrees not to violate the affiliate program rules but does violate the rules, then I cannot be held responsible for something beyond my control. It takes time to catch the violation, and moderators can modify the posting or ban the user. Do merchants view it this way or do they just put the blame on the publisher?
