I think Mr. Sutton's idea has merit, (thank you very much for joining our discussion and further explaining your idea). Isellstuff is correct as well about some of the issues.

For example, here in Colorado, they added a sugar tax, based on the flour content of an item. That means that a frozen Three Musketeers bar has a different tax rate than a frozen Milky Way (frozen has a different tax rate than not frozen!), and they had no clue what to do with flourless chocolate cake, or now, marijuana brownies.

Trying to create something nationally will automatically create winners and losers and fraudsters. No way around it. But that's happened with other national legislation as well. I don't have a magic answer here either, all I can do is just keep fighting it in my home state (like just a few weeks ago!).
