Tax Update

Many see Alibaba as a new threat to small online merchants, while others continue to point out weaknesses in the previously-introduced Marketplace Fairness Act legislation. The Affiliate Tax took effect in Vermont, and Amazon responded immediately by removing all affiliates in that state; this action is prompting Vermont legislators to consider modifying their legislation. Click-Through Nexus legislation was introduced in South Carolina. At the Federal Level, IL Sen Dick Durbin intends to reintroduce the Marketplace Fairness Act legislation to the new congress, while a bi-partisan group is introducing a different version of legislation in the House. A separate group is also introducing legislation to assure internet access will remain tax free permanently.
