A great informative article showing their is no limit to sleezy marketing on the horizon until strong laws get put in place. EarthLinks test for BHO installs is revealing as is the FTC's action committee reporting 63% of infected system users had no idea where those adware/spyware programs came from... We sure know who monitizes their dasterly deeds....THE NETWORKS.

One such tool facing allegations of abuse is SpyBan, an antispyware program that has been downloaded some 44,000 times in the last four months, according to Download.com, a software download site owned by CNET Networks, the publisher of News.com. Download.com removed the software this week, noting that SpyBan had failed to disclose and explain all the software components included in its installation, a violation of the Web site's policies.

SpyBan was found to install a file called Look2Me, which has been classified as spyware and adware by Symantec and Pest Patrol. It was named as a trojan horse by Kephyr's Roger Karlsson.

Apparently SpyBan is now in hiding.

Information and links on SpyBan's Web site disappeared late on Monday, following inquiries from a CNET News.com reporter. An e-mail to a generic "info" address at the SpyBan Web site elicited an initial reply, but the company did not reply to questions about its software.

Prior to going dark, the SpyBan Web site contained no information about its corporate parent, and the domain name database--Whois--that typically contains contact information for companies contained none for SpyBan.

The individuals behind SpyBan and other programs like it are nothing but slimy scumbags in my opinion. Watchout, you scumbags!

Everyone of these programs INSTALLs spyware/adware ...not remove it.

Here's some for all you AM's to purge from your affiliate rosters and they whacked my system. All from the same type of outfits turning your system into an Ad machine and porn palace. Sorry pervs...you can't get rid of the Ads without trashing to palace.

    More on this...

    http://news.com.com/2008-1032-5157799.html

    Interesting quotes:

"This case is symptomatic of the larger problems of fraud and deception and unfair trade practices on the Internet. We feel as though it is really the first in what we hope will be a succession of cases that will highlight some of the things that are happening online, so that some of the people that think they can get away with things due to the anonymity of the situation will not be able to do so in the future."

"We have seen an upsurge in techniques to try and get consumers to download applications...without actually having informed consent."

"According to our understanding of FTC law, they do bear responsibility if they were a partner to the action."

It could get interesting if it was found that BHO/Parasite installs (where there wasn't INFORMED consent") could make all parties profiting from that install liable.

That'd clean up the affiliate industry pretty quickly.

There is a law being submitted for approval making it both a criminal charge and imposing stiff fines for anyone registering any domain name with phoney Whois info. The Feds and worldwide law enforcement agencies all agree any domain name owner is to be held liable for any content or activity coming from their site. You own a domain you will be liable for criminal activities and civil fines eminating from that domains activities.
