Tax Update

The US National Conference of State Legislatures has expressed it is disappointment in the newly drafted “Online Sales Simplification Act of 2015” since it is based on “hybrid-origin sourcing.” New York’s Gov. Andrew Cuomo has introduced even more aggressive legislation redefining marketplaces to further force online tax collection. The Arizona legislature rejected a bill forcing internet tax collection, while Utah, Tennessee, Maryland, South Carolina, and Washington have begun discussions about taxing online transactions. . Amazon and other retailers began collecting online sales tax in Illinois effective Feb 1 based on their latest taxation law. Because of the extra work involved processing taxes involving multiple jurisdictions on a single transaction, 28 states offer businesses an allowance to keep a small portion of sales taxes in return for collecting them from customers and sending them to the state.
