    "Partner further agrees that it will not perform search engine optimization on Merchant's trade names, registrations, personality names or derivations thereof without Merchant's permission. Partner agrees that it shall not use trademark and registered names in the title or body text of any listing, whether paid for or not, which will cause affiliate's listing to return at the top of a query string when user is searching on Beachbody's trademark, registered or personality names is also not permitted. (example: Froogle Google). Partner understands Product Partners and Beachbody will not pay commissions to an affiliate who breach this agreement."

    So now, I guess we control search engine algorithms. Also, how are you supposed to sell Beachbody without mentioning their name? Look out coupon sites, if your SEO is better than theirs, you won't get paid. Pathetic, just pathetic.

    They are protecting their brand names, very reasonable thing to want to do.
    It forces affiliates to be creative.

    However, they could end up killing their affiliate program with this:
    'Partner agrees that it shall not use trademark and registered names in the title or body text of any listing, whether paid for or not, which will cause affiliate's listing to return at the top of a query string when user is searching on Beachbody's trademark'

    Considering the links in Linkshare include the trademark names, it would be hard to promote them if we are not allowed to include those names in the body text.

    While I understand the need to protect the trademark names, it is stupid to stop affiliates from using those names in the body text when the links that are supplied include those trademark names

    Once pitched a startup company in CA for their biz. Even though we'd signed an NDA they would not tell us what they did. Is it for consumers...yes. Is it for business...yes. They even said, at the meeting pitch us a campaign right now, on the fly. They would not even commit to their item being a product or service. A VS backed deal of course.

    In the end...

    ...they did free #D homepages

    ...we got the biz.

    ...they paid for 5 months on retainer to do nothing why they tweeaked their technology.

    All puff, no stuff.

    I just went to the Linkshare interface to "Delete This Merchant from My Account" and glimpsed this:

    Beach Body Special Tiered Offer 6.3 | 20%-30% commission on all goods

    Private Offer: 10% Commission 28.2 | 10% commission on all goods

    Good thing I never accepted their Private Offer. I's HALF of their normal commission!!!
