    As I see it, some key differences exist in the business methods used by Overture and Gooogle, and it may not be that Google is infringing on anything .


    Overtures patent , and the first line taken from the text : http://patft.uspto.gov/netacgi/nph-P...&l=50&co1=AND& d=ft00&s1='6,269,361'&OS="6,269,361"&RS="6,269,361"

    "A system and method for enabling information providers using a computer network such as the Internet to influence a position for a search listing within a search result list generated by an Internet search engine".


    The way I see it , there are some major differences between Overture and Google's Adwords/ Adwords Select Listings :

    Overture's patented technology allows bidded results to appear "within" a search result list,
    as clearly described in their patent .

    Google's bidded listings DO NOT appear "within a search result list", and , in contrast,
    are clearly titled " Sponsored Links" in advertising boxes appearing along the right side of pages across the
    Google website , or , more importantly, WITHOUT " influencing a position for a search listing" , as Overture
    filed with the patent office as the system or method they wished to aquire a patent for in the first place.

    Since Googles bidded listings in no way influence actual search results, and do not appear within a search result list , they can not be guilty of infringement .

    And, if that's not strong enough, Google can always join forces with Findwhat and challenge the validity of the patent as being filed too late, and therefore unenforceable .

    I kind of like Google, and really would love to see Overture lose . I think it all stems from hard feelings about losing Earthlink to
    Google, and Overture is afraid of losing all to them .

    Awesome...Overture trying to use the legal system to blow up the competition.

    I thought they had taken all the stupid pills they could possibly ingest...wrong again.

    I wish there was a way we could set up a legal firm specifically to sue the likes to Snare, Overture etc. and sell stock in it.

    Talk about a growth stock to beat the band.
