    Senate Panel Backs Anti-Spam Bill, Includes Jail

    WASHINGTON (Reuters) - Internet "spammers" who flood e-mail inboxes with deceptive pitches could face up to five years in jail under a bill approved by the Senate Judiciary Committee on Thursday.
    The "Criminal Spam Act of 2003" joins several other anti-spam measures advancing through Congress. Lawmakers had hoped to pass an anti-spam bill into law this year, but that looks increasingly unlikely as both chambers hope to adjourn in little more than a week.

    The bill takes aim at a variety of popular spammer techniques in an effort to stamp out deceptive commercial e-mail.

    Like another bill passed by the Senate Commerce Committee this summer, the Criminal Spam Act targets commercial e-mailers who falsify return addresses or otherwise try to obscure their identities. The two efforts could be combined before the Senate votes on the issue, lawmakers said earlier this year.

    "The time has come to curb the growth of spam on all fronts through aggressive civil and criminal enforcement actions, as well as innovative technological solutions," said Utah Republican Sen. Orrin Hatch, who sponsored the bill along with Vermont Democratic Sen. Patrick Leahy.

    Spam, or unsolicited bulk e-mail, now accounts for nearly half of all e-mail traffic, according to several estimates. Two out of three spam messages contain false information of some sort, the Federal Trade Commission said earlier this year.

    The bill would make it a crime to route e-mail through another person's computer or e-mail address, a favorite spammer tactic.

    Spammers who "harvest" e-mail addresses from Web sites or send out messages to millions of randomly generated addresses in so-called "dictionary attacks" would face jail time as well.

    Repeat offenders could face up to five years in jail.

    Efforts to pass an anti-spam bill in the House of Representatives have been stalled as lawmakers try to forge a compromise between several competing bills.

    Boy oh boy, I'd sure like to see this go through. The so called legit affiliates with 3 million opt in subscribers "un huh" that flood peoples emails with spam for merchants who settle for 1 in 10,000 resulting in a sale of which generates a whoping $700 something in commissions of which is used to justify a low commission rate will quickly become a thing of the past!

    When these merchants who partner with and allow these unscrupuous affiliates to spam are fined up to one million dollars themselves how long do you think they will continue to parner with affiliates that use email campaigns.

    Of course, for these SOB spammers "spamming not being worth the risk" will only drive these people to other devious alternatives that do currently work.

    It seems to me that the perrils of affiliate marketing will only continue to escalate from one devious technique to the next until this industry is cleaned up via legal actions. Unfortunately, it looks as we still have a long fight in front of us.

    Poon it is amazing thta before this legislation the anti-spam software industry was outpacing the revenue generated by spammers by a 3 to 1 margin. Problem is many of those paid software downloads have options which also block Ads and wash cookies. Networks harboring Opt-Out spammers and e-mail privacy info scraping frontend lead merchants also may be named as a party to the resulting law suits.

    Sure the scumbags paying dues and influence money to the DMA and IMA will seek out alternate revenue opting for sleezy BHO's causing more systems to get buggy drive-by installs. More consumer backlash demanding action. Microsoft might even flex it's power and complete lock all BHO's and trojan horse backdoors from it's next browser release.

    I'm content to not compete with spammy affiliates and the incent crowd and sit back and watch the destruction while preaching value add and meaningful landing pages for shoppers.

    Yahoo, NY Attorney General Settle Consumer Rights Case

    SAN FRANCISCO (Reuters) - Yahoo Inc. YHOO.O on Wednesday said it would pay $75,000 as part of a settlement with the New York Attorney General's office concerning its marketing practices.
    Under the agreement, Yahoo will pay the costs of an investigation into marketing changes it made last year, clearly notify consumers of any marketing policy changes and allow them ample time to opt out of promotional lists.......

    "It is neither appropriate nor legally permissible for a company to compile a database of personal information through an online registration process and then attempt to use the information for telemarketing purposes to target consumers who have stated that they do not want to receive solicitations," New York Attorney General Eliot Spitzer said in a statement.

    "Moreover, consumers need, and the law requires, adequate and effective notice about changes to the way a company utilizes a consumer's personal information," he said.

    Under the settlement, Yahoo must send an e-mail to registered users telling them about any marketing policy changes, telling them how they can decline and giving them 30 days to opt out of related promotional campaigns.

    Yahoo also agreed to not market to consumers who supplied a telephone number and who had declined marketing previously.

    The saga on the demise of e-mail marketers and their list broker spamming buddies continues.

    LONDON (Reuters) - British lawmakers plan to use a new tactic to stop the torrent of junk e-mail spam that floods in from overseas: extradite the mass-mailers and bring them to trial in the United Kingdom.

    "Spammers are no longer an irritant, they are a threat," British MP Brian White told Reuters on Thursday. The UK last month was the second European Union country after Italy to criminalize spam in a law that goes into effect in December.

    But the law has drawn criticism from anti-spam crusaders who say it will be powerless to stop the flood of messages at the source. The majority of spam originates overseas, and in particular, the United States, industry experts say.

    While initially, extradition would be used to target spammers, it could be expanded to include suspects in other cybercrime cases such as virus-writing and hacking, he added.

    White said he and fellow British lawmakers traveled to the U.S. earlier this month where they discussed with FBI officials extraditing American spammers who violate British laws.

    "The FBI's reaction was, subject to the individual case, they couldn't see any problem with it," he said.

    UK and U.S. law enforcement authorities have a long history of cooperation in criminal matters, a relationship that has only grown stronger in the wake of the September 11, 2001 attacks in America and their subsequent crackdowns on subversive groups.
