    Here's something that I picked up from LexisNexis today. The article is at FTC Moves to Limit Affiliate Marketing

    but I'll post the whole article since it's small:

    proposed new regulations to let consumers opt out of receiving
    marketing communications from affiliates of companies with
    which they do business. Companies would be prohibited from
    using customer information received from an affiliate unless
    the consumer had received notice and the opportunity to refuse
    such solicitations. An exception would be if the affiliate
    already had an existing relationship with the consumer. The
    proposed rule would implement a section of the Fair and
    Accurate Credit Transaction Act, which became law in December
    2003, the FTC said. The act also requires federal banking
    agencies, the National Credit Union Administration and the
    Securities and Exchange Commission to implement similar rules <HR></BLOCKQUOTE>

    Looks like it will be possible to go after the merchant when their affiliates spam. Could be good, could be chilling. The merchants may throw out the spammers but hopefully will be able to tell from responsible affiliates.

    This is not quite the same thing. This deals with lets say you get a credit card, and they sell your name to an insurance company or something.

    This covers when merchants give data to their affiliated companies to use to market the original company's customers. In our world, it goes the other way, we have first contact with the customer.
