    Affiliate Agreement Update
    Received this from Perfomics today:

    Dear Affiliate,

    Affiliate marketing is a partnership between marketers and affiliates. These partnerships are governed by the Performics affiliate agreement and the terms and conditions outlined by individual clients. These agreements provide guidelines for affiliates that must be respected for partnerships to prosper.

    This notification addresses an emerging tactic that is prohibited by the affiliate agreement:

    Affiliates purchasing media through third parties that operate or distribute downloadable software and/or resell inventory tied to third party software in conjunction with client (marketer) trademarks.
    An affiliate may not purchase media for a client trademark without prior written approval from the client. Affiliates are not allowed to specifically advertise for, or target against, our clients using the clients' names, trademarks, or service marks through any third party applications, directly or indirectly, without prior approval from the client. This includes, but is not limited to, using marketer domain names to trigger pop-up ads for competitors. Affiliates who violate these policies will be subject to immediate termination of the relationship.

    Please reference Section 8 (b) of the Performics affiliate agreement for clarification:

    Each party shall comply with the other party's requests as to the use of the other party's Licensed Property and will avoid any action that diminishes the value of such marks. Without limiting the foregoing, Affiliate shall not, without written permission from Marketer, (i) use any of Marketer's brand names, keywords or derivations of either of the above for any purpose; or (ii) purchase any URL containing any of Marketer's brand names, keywords or derivations of either of the above.

    We appreciate your efforts and your support of our clients' affiliate programs. However, it is important that affiliates operate within the agreed upon guidelines. Clients have expressed concern regarding these tactics and we felt it was important to share the issue with you.

    Sounds like they too have smarten up to what various games the pseudo alt-networks can do to speed up draining merchants commission budget accounts. Wow ...who'd have thunk the BHO popup perps would team up with domain affiliates to give them a keyword-rich HTML URL page to popup on, setting some competing CC Co's cookie too. Just split some of the Super Affiliate commission arbritrage back to 2nd tier affiliates posing as a network.
