    Company settles spyware suit for $7.5 million - Spitzer/NY vs Intermix Media
    Intermix Media has agreed to pay the state of New York $7.5 million to settle a lawsuit charging it with bundling hidden "spyware" along with millions of programs it gave away for free, the company said Tuesday.

    The Web marketing company also said it would permanently discontinue distribution of its adware, redirect applications and toolbar programs, all of which Intermix noted it has previously stopped distributing. Intermix said it did not admit any wrongdoing or liability.

    The broader and long-term benefits are certainly decreased by a settlement vs. a court win.

    The $7 million settlement only settles the claims of (and harms to) New York consumers. Consumers elsewhere still have rights, and could yet bring further litigation of their own (via private attorneys or other states' AGs).

    So, in this context, $7 million seems like a sizable, large settlement.

    And now the company has been sold to Rupert Murdoch's News Corp. for $580 million. That $7.5 million is just a drop in the bucket.

    Shame on MySpace. While I disagree with the spyware, I do admire what they've done for viral marketing with the social network system. Ever since Friendster was released, I've been an advocate of social network technology.

    Rupert bought the impressionable demographic. If he doesn't clean house on the Intermix Adware/Spyware management he'll get rheemed by that consumer group on any attempts to shove Advertising enima tubes up their butts via bundling tricks and poisoned BHO popups. That group has wisened up to Adware after being victimized for years.

    Intermix had already put 6.9M in reserve for the case. Funny how the settlement amount so closely matched the amount in reserve.

    Now with the announcement of a sell @ $580M, it all kind of makes more sense doesn't it? You don't broker a sell for that amount of money overnight.

    Part of the proposed settlement was that Intermix had to stop the adware stuff. Intermix has other stuff outside of their adware. I never saw what actually went through the Courts for approval for the settlement or even if it did. I would think that pesky business would have been cleared up before a sell but you never know.

    That $7.5 million is just a drop in the bucket.
    Yep. Not to mention their stock went up when the settlement was announced. Don't know how much they made on the stock price jump.
    so where's mine?
    Somehow I don't think the State of New York is sharing.

    Next court date for this case is July 26th. Maybe we'll be able to see the actual contents of the settlement at that time.
