Thumbs up Kaaza, like Grockster, Loses court case
Looks like the BHO's are going to have to find a different hidden bundling partnership as the P2P wanks get gutted. Look for more immediate shanky bundling installs and more drive-by installers as the BHO's try to meet their greed mongering owners numbers. P2P won't have the "Let's Loot" the music/video industry neon sign flashing. The desperate BHO moves will further p*iss off consumers who get louder at demands to Tar & Feather online advertisers and their AdWhores.

...""It can't be fair to build a business on somebody else's work," he said.

However, the applicants were "absolutely delighted" with the judgement, according to Speck.

"It's a great day for artists, and music," he said.

"The consequence of this [judgement] will have global impact."
Importantly, Justice Wilcox had ruled that Sharman would have to make considerable change to Kazaa if it wished to continue its business, according to Speck.

"The court has made orders in that [Kazaa] has to be legitimate or disappear," he said. "It is up to these people to honestly and decently stop ripping off music. "If you're out there and you're ripping off music...sit up and take notice."

The best article on this that exposes the affiliate networks monitizing role in music theft is at http://news.com.com/Australian+court...3-5849480.html Seems AltNet pulled all the strings to use Kaazaa as their Adwhore front end.

"On the heels of the unanimous Grokster ruling by the U.S. Supreme Court, this decision reflects a growing, international chorus: those who promote theft can be held accountable no matter how they may attempt to escape responsibility. A corrupt business strategy of attempting to hide 'off-shore' is not off-limits to the enforcement of rights by creators or law enforcement," Bainwol said.

The Australian decision comes a little more than two months after the U.S. Supreme Court ruled unanimously that peer-to-peer companies--most notably Grokster--could be held liable for copyright piracy that occurred over their networks. As part of that ruling, the justices returned the case to a lower court for further action.

In the Kazaa case, Wilcox said the applicants had refused to implement technical measures that could curtail, though "probably not totally...prevent" the sharing of copyright files, as to do so would not be in their financial interest." .... " Judge Wilcox also ordered respondents Sharman Networks, LEF Interactive, Sharman CEO Nicole Hemming, Altnet and Brilliant Digital Entertainment boss Kevin Bermeister to pay 90 percent of the music industry's court costs. "

The Altnet/TopSearch PPCSE partners are getting ready for some investor fallout.
