    Abestweb's DMCA Policy (and general DMCA questions)
    I noticed that more and more forum webmasters are posting their DMCA policy to protect themselves from the possible infringement of their forum users. I have a few questions for the community general:

    1. I know that the DMCA has safe harbors for ISPs and other content hosters. Does it also cover forums?

    2. Does anyone here run a forum and plan on using DMCA safe harbor to protect themselves?

    3. I read on chillingeffects.org that aside from posting a DMCA notice, you also need to designate an Agent for Notification of Claims of Infringement at the US Copyright office. I couldn't find one for Abestweb on the COpyright office's website. DOes this mean chillingeffects.org is incorrect or that Abestweb should designate an agnet (Don't worry, I'm not suing you guys or anything, I'm just curious).

    Thanks for the offer Haiko.

    I don't really have any specific questions relating to Abestweb. I only used it as an example because I know this site is always doing the right things, and therefore I want to follow your example.

    My general question is just that whether DMCA protection is standard practice among the big forums and whether one needs to register with the copyright office when seeking the DMCA safeharbor.

    There was a session at the Affiliate Summit on legal issues, and the lawyer highly recommended putting a DMCA policy on your site.

    Rexanne, DMCA stands for the Digital Millennium Copyright Act. Under the DMCA, ISPs and other content servers can avoid copyright infringement liability if they follow certin "safe harbor" provisions. I believe the steps include posting a DMCA notice on your site and registering your designated representative to receive DMCA complaints with the copyright office. I don't know that much about it, but you can find good info about the DMCA here:

    Poker, I see the safe harbor as mearly a SOP and not realy protection, there are many points not really discussed in public (for obvious reasons) that are forum specific.
