    How to get Yahoo/Geocities to take copyright infringement seriously?
    Does anyone have any idea on how to get Yahoo/GeoCities to take a copyright infringement complaint seriously?

    Someone using the GeoCitites service has copied one of my sites designs, stole my original images, and is hot linking to some of my other stuff. They have no contact information on their site, so I contacted Yahoo/GeoCities directly and outlined exactly what the website was doing.

    I provided them with material that showed that I am the copyright holder.

    They wrote back 2 weeks ago and asked me to send them some more information, which I did.

    I have heard NOTHING back and the site is still up.

    I have written to them a couple of times since and no response.

    Any ideas on how to get them to wake up and take this seriously? Should I send Yahoo a Cease & Desist letter?

    Not much you can do short of hiring an attorney.
    If they are hot-linking to images, make them say something very vulgar so F*** You or something of the sort shows up on their site and then rename the real ones you use on your site.

    I did something like that once. Somebody was hotlinking to one of my images and having it repeat over and over to form a background on their site. I changed the name of the image I was using and changed the image name they were using so it said "I will not steal images from other sites!". That message then was repeated all over their site.

    After leaving it that way until they found it, I changed my settings so nobody could hotlink to them.

    You should be able to at least stop the hotlinking immediately if you don't want to have some fun with it first.

    Changing over the items they are hot linking did occur to me. As a matter of fact I have an image I create and keep on hand just for that purpose, however this time most of what they hotlinked are sound files. They just flat out download my images files and uploaded them into their geocitites webspace.

    Is there any way that anyone knows of to find the contact information for a website on Geocitites?

    They do have a guestbook... I thought about leaving a cease and desist in there....

    Send a C&D to GeoCities. Since it's on their domain, it's technically 'their site' so it's up to them to remove it.
    Surely they'd rather terminate the persons account for violating the GeoCities Terms of Service Agreement, rather than face legal action.
    Or... get a trademark on some of the things too. That way in the event of a Cease and Decist against GeoCities, they'd move really quick (or be forced to pay up a lot more for trademark infringement)

    Go to their homepage. It should look like ht tp://ww w.geocities.com/username/index.html

    Then, try sending a friendly email to username@yahoo.com - they should have an email account at this address. Make the email complimentary and ask for a response. If you make this first email threatening, they may not respond.

    Once you verify that they have this email and check it, then send them an email stating what legal actions you are planning.

    Send a DMCA complaint to Yahoo. They HAVE to act on that.

    Agree with Drewbert. There is a reason when legal action happens you get a cold letter from a lawyer, everything else is just happy fun talk until you serve the C&D. Check out http://www.chillingeffects.org on how to write the C&D.

    A C&D is the official way, and will probably work.

    But a way to get a double-zap in would be if you:

    Change the image files so porn is on the hotlinked ones (make sure to make it so your own site still has the clean stuff).
    And then
    Complain to Yahoo about the porn (as if you're just a regular user)!

    Chances are they'll take it down for having porn even though they don't seem to care about the copyright violations.

    I've sent more than 10 emails to both the site owner and Xanga because a lady there has hot linked a bunch of images from my site and encourages others to hot link them for their sites. Grrrrrrrrrr - Eats up plenty of bandwidth that I end up paying for. I tried to explain NICELY what the deal was to this woman but never heard back so I finally sent her an email telling her she was an idiot and gave her hell which didn't generate a response either. She's still hot linking my images and so is half of Xanga now. I never got a response from Xanga either.

    I can't set my graphics to not be hot linked because of the way I've set up another 2 domains that are connected to my main domain on my server. If I set the site to no hot linking, all the graphics don't show up on my other 2 sites.

    Since I will be changing hosting companies as soon as I can think straight, I'm not going to bother moving things around and changing images to nasty ones even though that's so much fun. A friend of mine replaces all of her hot linked images with a picture of her dog licking his privates. LMAO - It's hilarious to see it on someone's squeeky clean "family friendly" site.

    There's a way to set things up in htaccess so that it will allow calls from certain web addresses, and all others are outta luck (they get a little red X...or whatever else you want to show 'em).

    Let's see... *Checks the G*

    Here's an .htaccess that'd shut off that Xanga idiot (I replaced the example URL with "xanga...")

    There's a few more anti-hotlinking htaccesses on that page, too. It looks like you could modify them to either only allow linking from authorized domains, or expand the one I quoted to disallow more than one unwanted dom...

    Yesterday I decided to fax Yahoo the information at their fax number for copyright complaints.

    I am calling on Monday since nothing has been done. Depending on the results of that phone call, I have the C&D all ready to go out to Yahoo if need be.

    I was going to make a little recording to replace the sound file that they are hotlinking to with something loud and clear announcing that the owner of the website was a f'ing thief, etc. etc.

    Just make sure you put the name of your own site on this. I made the horrible mistake of replacing some hotlinked images with a graphic that said this image was stolen, however, forgot to mention that it was my site that they were being stolen from. And months down the line, decided to look at the entries for my site in the Wayback Machine, and horrors! The images were there, looking as if I had stolen them. Doh, doh, doh, doh, doh!

    Everything will else be a waste of time, it has to be. Yahoo has a right to protect their users. They don't know you, they don't know you speak the truth. But if you send them a formal DMCA C&D, they know you are legally willing to go out and say this is true and take the consequences if you are lying.

    This is not to say in anyway yahoo/geocities has acted improperly with your case. They haven't. They have behaved just as they should and people need to understand this. There is no half-way step to get content like this removed, you must file an official DMCA notice and then they have a small window of time to react to that complaint.
