    Merchants - If I can't use your name I can't use you
    I understand restrictions on using your company name.
    BUT ... and this is a big but, if your TOS says I can't put your name on my website or any content on my page, guess what?

    YOU WON'T GET PROMOTED AT ALL

    Marketing as defined by clueless merchants: Everyone already knows us. We're a household name. Why? Because we're the best. We'll throw some advertising your way to help you out. Just don't use our name. We don't want it just tossed around just anywhere. Our customers already know we're here. Ad copy? Oh, just take this going out of business sale flyer and use that.

    Feel free to use our name on every page of your site... As a matter of fact I have some custom made banners on the way with you in mind! How does a general 88x31 and 728x90 sound? I can customize them for you if you like, just say the word and its done. Ill even put your sites colors in them if you want We love seeing our name in lights

    That's funny popdawg, the only instance where we do allow our content and name to be used is for affiliates.

    I think they learned that trick from Not-Famous-Any-More-Footwear. Ooops. I don't think I was supposed to say footwear when referring to them.

    I don't know what company is being discussed here, but I imagine it is safe to guess that their website and advertisements are loaded with references to all the "brand name" products they carry in order to show they sell quality products.

    What's the difference between a company telling the brand names it carries and a web page telling the merchant(s) it carries?

    You would think so wouldn't you?

    But over here in the UK I can think of 2 or 3 instances over the last few months where some huge online brands have made issued similar TOS.

    In my opinion I think this is due to over-zealous media agencies who are "looking after" the merchants online presence and either (a)don't understand affiliate marketing or (b)want to control the brand completely themselves and hence rake in more commission from the merchant or (c)all of the above.

    So, I guess, that means that if we have a section for tents and we use 10 merchents we should make it nine and not use Backcountry, right?
