Just look at this
Apparently my domain name abacuswebhosting.com expired whilst in the middle of moving to Alberta. I tried to change the details to renew it, see my email and their reply.

The domain name abacuswebhosting.com is not registered with our company you will need to contact ENOM
    Thank you,

Yes apparently it expired at the end of December but due to changing email addresses and waiting for a reply to my email it was sold. I have just had e reply now here it is, it looks like I have lost it

I will write to the new owner but I guess he will want too much for it.

You might try contacting the current registrant to see if they are interested in selling the name back to you. They might not have any use for it and be quite agreeable.

Otherwise your other option is to file a claim with the Dispute Resolution, details at:

Gordon, sorry that happened. I wish there was something that could be done Gordon!

My personal experience with network solutions isn't the best...., I've been trying to switch registrars for a domain of mine for over a month now...so I can renew my registration for much less $$ elsewhere.

Network solutions keeps denying the transfer for a bunch of little nonsensical reasons..., I've called and sent emails filled with f**** word, it still isn't transfered and I have 18 days left to renew the registration.......

If I have to pay their fees because they are screwing with me about the darn transfer I am going to be pissed!

I will renew with them though if I have to because I can't afford to lose this domain right now, its makin good money!

Right now this name is earning $7.24 a day on average. I have advanced a developer $900 to develop the domain for me. It will cost you approximately $2000 to file a claim plus attorneys fees. I will meet you part way and sell the domain for $1500.00 to cover my expenses and a part of the minimum revenue expected.

Shouldn't cost that much to file a claim, whether the claim has merit or not. I wonder how much it would cost for him to defend it?

And theres probably more mischief / fun to be had than that :/

He has a list of hosts there to choose from - affiliate links I'd guess, but I didn't check.

Gordon, is that how you ran things or were you a hands on host more like Tom from THMedia?

    Gordon,

The @home fall has caused many a snafu!

It is common knowledge, in the industry, that many providers needed to contact all the @home addys to update thier db, I am pretty sure because of their negligance to do so, you would have a claim. I will follow up with them for you, as before. If I fail, I will give you an even better hosting domain (not used) that I own.

Unfortunately with @home situation the people at Shaw cable, the same people who gordon has and the ones who took on the hosting after @hoome crashed did give us lots of notice about the impending doom.
My attitiude is screw em, set up a new site make it 100 times better and blast the old stolen one out of the water.

Still feel that it sucks you had to go through this though.

You guys, your great (I wanted to put a thumbs up but I don't know how)

I knew @home was closing but unfortunately we were in the middle of moving house/Province and we had to stay in a motel for 5 weeks. When we got the house the first thing we did was get shaw cable but in that 5 weeks apparently the BC. shaw cable office LOST all or some of their email databases, of course mine was amongst the lost ones.

Also what made it worse I registered the name with alldns.com who transfered all their business to AWregistry when they did that I was not sent a new password to access the information, (registered owner details address & email etc.) As you can see from the emails I was in the process of trying to get a new password from AWregistry when I found out I had lost it. sh*t happens

I have not had time to view Toms site yet but I was a reseller. I think this guy is just an affiliate with lots of links to different hosts.

@everybody Thanks for your suport it is much apreciated as I am feeling pretty down at the moment.

Consider that when he bought the domain he would just know that it was available, with no way to know why. He'd have no way to know that the previous owner lost it because of a glitch, and neither would he have reason to expect a letter from the previous owner. The fact that he was willing to negotiate on the basis of recovering his costs and a token compensation for sacrificed income is not unreasonable. He could have just said to go fly a kite, after all.

This situation is frustrating as can be for Gordon -- it could happen to any of us! -- but that does NOT make the other guy into a scumbag.

Normaly I would agree with you on that point but for the fact I know the site was not in operation yesterday morning so how he can come up with those figures is beyond me. All he has done (this is either last night or this morning) is point the domain name at an existing site. I think it was findit.com or something like that.
quote:
but that does NOT make the other guy into a scumbag.

    Gordon,
Sorry to hear about your experience. I always encourage people to use some type of reminder (our registrar has one built in but even then). Unfortunately, in your case, all of the reminders in the world would have done no good. If there is anything we can do to assist you, please let us know. It sounds like Haiko has the best suggestion...may end up starting from scratch. I don't know what legal things you could stand on, since I am no lawyer.

@MsMarySunshine, if you keep having problems, let me know. I may be able to get things worked out for you over at Netsol. Many of my clients have had isses with them, and I tell people to run far, far away. Let me know if we can assist you in your transfer.

Gordon, I hate to say it but I think you've lost it. Unless you had some trademark or other real-world claim to the name I think the new owner is sitting pretty.

However, the revenues quoted by the new owner sound like bullshit and bearing in mind that you're probably the only customer, you're negotiating position is gonna be pretty strong.

I'd say it's probably worth not more than about $300 as an estimate (he's probably used SnapNames for $69 to get it). Be polite but firm in your negotiations, but don't pay more than you can afford for it.

    Thanks very much Haiko

    @ Icicle
I am just hoping they will still continue with me if and when I get the site running again. At the moment I am paying for their hosting (for four months now) as I do not like the idea of billing them whilst my site is down. Their sites are still up and running with no problems.

Thanks for the offer! Everything just got staightened out a couple of days ago, thank goodness. What a pain! The problems were so vast...., I didn't use NetSol to register the domain originally, they aquired the co. that I used and then my original passwords wouldn't work any more because NetSol issued new ones when my reg. transfered to them. Then they wouldn't give me the new password by email or phone to get into my account and update an email adress so I could respond to their emails....blah, blah, blah big pain in the arse!

I agree that "Run" is great advice.

    MsMary,
Glad to hear that it has worked out for you...still a pain the b*tt, nevertheless....I've had a recent customer in the same situation...Netsol took his registrar over, and he ran into the same problem as you with usernames and passwords. I would recommend moving to another registrar when it comes time for renewal...
