    Spamhaus lawsuit?
    Hey guys,
    Anyone hear about a lawsuit being won against Spamhaus today? I tried to Google News it, but didnt find anything...

    The thing i heard about was some emailer who sued spamhaus and won...were you able to find that one?

    Where did you hear it from? I Googled it and haven't seen anything, so you must have got the info from someone in the know?

    if it is true, it should pop up on google in a day. Did some googling and no luck as of today besides the Sept 5 article i posted

    Every time I get spam, I ask myself "WHY do they insust on bothering me?"

    According to the evidence presented at the trial, Jaynes, 32, grossed more than $24 million in various e-mail scams.
    Now I know!

    Then I ask myself "Who the hec falls for this stuff anyway?"

    Jaynes also peddled a fraudulent home business idea, which in one month alone brought in 10,000 credit card orders for the $39.95 scheme.
    and

    The Virginia charges cover a 30-day period in the summer of 2003 in which Jaynes and his associates sent ... more than 100,000 for the period.
    That a 10% conversion rate! That's better then my best merchant

    This (the default judgment by spammers against Spamhaus, after the spammers earlier abandoned another suit that Spamhaus spent money to defend) has no precedential value; it is just a sleazy trick used by spammers to get publicity to try to frighten honest people.

    Like Spamhaus, I was sued by a spammer (back in 1999), who was upset that his ISP pulled the plug after he used their pipe to send unsolicited commercial email (I'd reported this to his ISP).

    He sued me in Pennsylvania court (I think the lawsuit was 99% about getting publicity). He might have hoped that I would not spend the money to hire a lawyer to oppose the case, or even that I might try to defend myself (since I am a California attorney). But he also knew that even if I did not respond to the frivolous suit, the PA court had no "jurisdiction" and thus any default judgment he obtained would probably not be enforceable here in California. (He certainly didn't want to sue me in California, because we have a law that allows defendants to collect attorney's fees when someone files this type of malicious, frivolous lawsuit intended to block free speech.)

    After I spent $5,000 on lawyer's fees and filed an opposition brief, the spammer abandoned his lawsuit -- sending a letter to the judge falsely claiming that the case had been "settled."

    Man, that sucks big time. Waste of your time, money and grief for a lawsuit which was filled by the spammer. I think it is more of a scare tactics that they are using to put out there so that one would think twice about reporting him or dragging him/her to court.

    I doubt that they will recover the $$ since the article mentioned that Spamhaus is in Euro. Not much jurisdiction.

    Since Spamhaus is based in the UK, the ruling is irrelevant.

    There's nothing like the sound of spammers squealing though.

    FYI, these are the broadly agreed "rules of spam". Rule #3 is particularly relevant.

    The Rules Of Spam

    Rule #0: Spam is theft.

    * Angel's Commentary: Spammers believe it's okay to steal a little bit from each person on the Internet at once.

    Rule #1: Spammers lie.
