    Here we go again. We're into tax season, and inevitably some merchants will not send out 1099's even though their affiliates earned more than $600 (that's the IRS threshold for 1099's).

    I usually get really upset about the delays, missing 1099's, etc.

    But now I'm not sure that I should worry at all. When a merchant sends a 1099 form to an affiliate, it also sends a copy of the form to the IRS. That's how the IRS knows how much money was paid to the affiliate.

    So, no 1099 to the affiliate = no 1099 to the IRS, and no record of the earnings.

    Am I missing something here?

    In case they tried to send it to you, but it fell behind their desk, the IRS will have its copy even if you don't have yours.

    If you know how much it was, you can report the income even if you didn't get the form.

    "Legally" you are still responsible for all income, reported or not. Even the under $600 stuff.


    IANAL nor an accountant but, and I'm all for not giving the IRS any more money than neccessary, but, technically you're sposed to report it all.

    Merchants: Do you realize that some of your affiliates are being paid commission on sales which you have paid for via PPC, offline advertising, and your targeted mailings?

    I always feel sick when I hand over all of that money. Makes me wonder why my brother in law has not paid taxes in 25 years and not one soul has ever garnished his wages or collected from him. GRRR! Some guys have all the luck.. in the mean time I am having fun calculating how much I get to pay this year Goodie!
