"I've only seen the two-line blurb in my daily Los Angeles new case filings report, but this ought to be a really fascinating piece of litigation: New.net Inc. v. Lavasoft and Nicolas Stark Computing AB. The summary of the case in my report reads: "Complaint for false advertising, trade libel. Defendant falsely targets plaintiff as a 'Data Miner,' and prompts the computer user to remove the New.net's client software." "

Interestingly, not a word about this appears on new.net's website - must be hoping it stays off the radar as long as possible.

Interesting to see how they get on, considering Lavasoft is in Germany.

But another thing to consider is this:

Lavasoft's program also calls CJ's and other networks' cookies "data miners" and prompts users to remove them!

The next lawsuit by a company with Idealab investment, may be one by CJ to force Lavasoft's AdAware to stop calling our cookies data miners and prompting for their removal!

Idealab has a stake in seeing that those cookies stay set...(convincing them that it matters who did the setting is another matter but Lavasoft deleting them altogether isn't what I call a viable alternative!)

So while I'm not too thrilled that they sued through New.net, the basic idea of reigning in AdAware is something that may not be so bad.

Good point Leader, but with all the slack and malarkey CJ has been getting I find absolutely absurd that CJ didn't sue or take action against real violators like Kazaa and others with the host files. Yes obtusely CJ via New.net maybe taking a stance on the cookie issue but ... how is this going to affect anything relative?

DataMiner or cookie, same difference ... just richer lawyers!

But..the simple fact[opinion] is that affiliate tracking cookies are data miners, and, there is nothing illegal about a hosts file blocking whatever you want... and for the umpteeth time its not kazaa its kazaa lite that has the ad blocking host file...

As biased as I am being in affiliate marketing, and having a vested interest in seeing that 1) the cookies arent removed prematurely, and 2) the tracking servers are not blocked, I have to face reality here....
