The decision to drop the lawsuit comes as no shock to me at all. Afterall, what serious affiliate would market their products knowing all the tactics they deploy now?
Seems to me that the parasite companies are the only true friends Overstock now has since they burned their bridges and they are right back to were they started in the beginning .. "most likely" best of buddies with Claria & WhenU.
I have not checked to see if Overstock ads are appearing with Claria yet, but you can be assured it is soon coming, if not already.
That's my 2 cents.

Ray,
For the record, Overstock.com is out of the following applications:
Mo Money Maker
Claria (Gator)
N-case
Golden Retriever

LOL ..bet those applications trashed your testing systems. You guys need to spring for a system or notebook for Patick Byrnes as the rumor was he's never owned one. You can still test your domain getting those pops due to drive-by and hidden bundling installs.
Wouldn't Gator/Whenu cut you a deal for not targeting Overstock links with Smartbargains and Dealtime offerings? They have a protection fee racket going for you major players.
Mike & Charlie ...
If they won't adopt and feed a bird ..flip them one! BBQ some Gator and remember to flush WhenU..

I guess that eliminates me from the "serious affiliate" category. Overstock.com is one of my top programs.

Have to agree with Michael. After a long thought on it last fall, I thought what the hell and tested them on one site. At some point you have to reward those who change, and I think they have changed.
I am more than happy with their conversion (even after the holidays) and their selection. Wish their commission was higher.

I can't get past the out and out lies that we've heard from Overstock in the past. For the sake of those who are promoting Overstock, I hope they have turned around, but I don't share your confidence in them.
